Dear Lady Doing an Infomercial About MArketing With
My Art as a BackGround Without My Permission,
Why are you doing a company sponsored info-mercial in front of my personal art installation?

You babble about about creative˙commons community blah blah blah
and never got permission for using my art in your company sponsored (Symantec, MicroSoft)
infomercial from me!

The Fungus installation was my most personal work ive ever done, whos point was as stated in the artist statement:
"purely self gratifing, avoiding reproduction, avoiding all packaging", and yes, marketing!
I feel like that boy from that U2 cover, they stole my installation's SOUL!

My art has appeared without permission as backgrounds to public access TV shows
where parapalegic performance artists have grind core sex and I never freaked out.
What can you do, right? they weren't selling anything (except all the other channels i suppose ... )
People can screen grab my art, not a problem. Not everyone can afford to buy art.
(and they arent selling anything in front of it!)
People podcast and download Attaboy and Burke songs for free all the time and thats cool with us,
Last year i denied rights to use my art in a Hillary Duff movie to avoid it being subject to bad storylines
but something about THIS makes me even more qweezy because its like, ironic?
and its about community based marketing!?

Quantifing word of mouth viral enthusiasm IS genuine regular MARKETING!
People who use this "new (corporate sponsored )anti marketing marketing"
jargon are just like their higher paid counterparts! YOU ARE THE SAME.
Your Powerpoint presentation pie charts( http://www.horsepigcow.com/pinkomarketingnet2.pdf ),
with its revolution graphics do not make you a
"rouge marketer."

One last thing. Ive never understood is:
EXACTLY WHAT DOES A MARKETER DO?
I Understand what a Salesperson does, theyre necessary. They Sell stuff.
i understand what a designer does. They Make Stuff.
and I understand what an Advertising Person does. They get the word out.
but a marketer? seems like theyre reactionary leeches who exploit or
try be the first to Co Opt yesterday's street trends, emerging technologies
and focus testing to create a job for themselves.

You are the fiends who made artists and writers into "Content providers."
and are responsible for making good ol' capitalism into something unbearable,
an irritating culture filler -like replacement, a "me too" environment ,
filled with the latest jargon speak, microwaved to luke warmness with "synergy."

I would force you to take down the video, but instead, I think if people
see it, they will pee their pants with how dumb it all sounds.
It is my Easter Gift.

Hey Attaboy,

Well, although I understand your rage, I think it may be misdirected.

This video happened to be shot by Eddie Codel, who volunteers at Net Squared, a project branch of the not-for-profit agency Compumentor, who spends time trying to help other non-profits get up to speed with technology and business. I happened to be there at Varnish, volunteering my time to speak about marketing.

Eddie loves your art and wanted to shoot it there. He edited the video and it resides at Net Squared's blog.

I'm not a capitalist...quite the opposite. I've been raked over the coals for my 'socialist' ways (I'm a proud Canadian). I know it sounds trite, but I'm trying to change marketing from within. But I spend more of my time actually fighting against consumerism and fighting for individual empowerment, whether through spreading open source or creating spaces for independents to speak out and gather.

I know I speak from a point of privilege. I know I come from a middle-classed white bread background and that marketing is 99% of the time, actually making the world a worse place (and advertising is part of marketing...so is sales...btw. Marketing is the process of taking a product or service to a market, including closing the feedback loop into product/service improvements). I refuse to feel guilty about that, but I certainly did not intend to steal your soul or any of the like.

You display your artwork in a very public place. I'm certain there will be more appearances of your work in other pieces. Two other videos were shot in front of it that night (of the two other speakers). None of these videos intended to make money or to exploit your art in any way. I can ask Eddie to re-edit the video and remove the reference to your art. I doubt if he can edit out the background.

Anyway...I'm sorry you are angry. I don't know if you would be so angry if you actually met me in person. That's the beauty of this online thing. Feel free to drop me hate mail if you would like. It is horsepigcow at gmail dot com.

Hey Attaboy. I take responsibility for shooting that video in front of your art. I picked the location but never with the intention of exploitng you. I did include a credit to you from where the vid was originally posted.

I did ask one of the Varnish owners if it was cool and she said yes. In hindsight I really shouldn't have shot it there as you were the one I should have asked. I take complete responsibilty for fucking up and will do whatever you feel is appropriate. I can kill the video completely, or re-edit it giving you credit in the video like I should have in the first. I completely understand your outrage at discovering your art used without giving permission, especially with corporate logos in it. Please understand I'm a total fan of your work which I think you know. I have both Hi-Fructoses, was at your launch party, etc. My honest intention was simply to have more people see your stuff and hopefully buy something from you. I know not all the Varnish pieces had sold yet.

Heres my solution to this conundrum.

1. Please keep the video(s) up (hopefully forever and ever)
so people can decide for themselves how silly Pinko Marketing is.
2. Please remove any link/credit to me, as I do not endorse infomercials for marketers
who pretend they're not selling anything.
3. Please make me a Peanut Butter and Jelly Sandwich, and all will be forgiven.
Said Peanut Butter and Jelly, hence forth known as PPJ should be tasty and NOT
made with that godforsaken GooberGrape Brand® jelly/peanutbutter.
We can orchistrate the deliverance (minus the banjos) of PPJ at a time that is
suitable for both of us.

I just wish you knew that, although often misinformed, I don't operate for evil (the basis of PM is that if you don't operate ethically, you suck - ethically, meaning that you really care about the community you serve).

Hi Attaboy.

1. No problem, they're not going anywhere.
2. Done. Links from the site and vid are gone.
3. GooberGrape does not show up on my consumption radar, so only the best extra tasty ingredients will be used in said sandwich. Are you a connoisseur of the whitest of breads, or do you prefer something say a bit more complex?

For the record, I learned a valuable lessons about assumptions and stuff. The last thing I want to do is exploit anyone's hard work or passion for any reason. I will certainly tread with awareness and consent in the future. Thanks for understanding and being a fountain of brilliant passionate creativity.

Sounds like you're also pretending that you're not selling anything. You're an artist. I assume you need money for PB&J. Do people ever pay you for your art? I hope so, cause it looks cool. Nothing wrong with that.

I agree with most of what you say, actually, but turning down a Hillary Duff film is no cause for getting on your high horse. That's a pretty freakin' low standard to start with so you don't get any point for it.

If you want total control over how your art is used and who sees it, then I suggest you hang it on your fridge and invite your friends over and don't quit your day job.

I got mad when i saw that my art was used as a background for a infomercial without my permission taht was being shown publicly.
No one asked for my permission.
I got irate when I saw that there were corporate logos in the video, and links to riya.com and others.
I got furious when I heard you speak of creative commons and ethics, when my art which was used without my permission and saw a link to my site,
which inferred that i endorsed your Pinko Marketing, the companies and links mentioned. I found this hypocritical. and as my legal friends and every artist i spoke to said: against the law.

the assumption that any promotion is good promotion for work that i created and that i didnt have control of the context i wanted my very personal art shown in a piece promoting someone else.

I created my art pieces as a daily journal entry for personal reasons.I showed it not in a very public place, but an indoor gallery.

This is important: I did not know you, what you were about, what you were saying, who you were endorsed by or friends with. And that shouldnt have mattered. If you were craigslist or Ghandi I still would have been upset for not being asked, good intentons or not.

That being said:
-I find out that Eddie Codel shot the video, that his
intentions were good and that he does great things.
That you didnt choose the location, he did. and that both of you seem to be decent people. I shouldnt have had to research the people who used my work without permission tho. and i think you guys might be in an insular virtual community where everyone knows your goals, ethics, and intentions. I did not and shouldnt have to know. You guys certaintly didnt research me or asked me what i wanted. and thats wrong.
-I still dont agree that pinko marketing is anything but marketing in nice guy clothing. I still believe that marketers shouldnt run companies. but thats me. an besides the point.

I will not bother with this stuff any longer.
I will not sue or even do a cease and desist. I just want my links taken off for something i dont endorse, and a Peanut Butter and Jelly sandwich from Eddie and all will be forgiven.
